Terms and Conditions of Sale

  1. GENERAL. In these conditions "The Company" shall mean NF Metals and "The Buyer" shall mean the person, company or corporation placing an order with the above company.
  2. PRICE. The Company reserves the right to amend prices at any time consequent upon increased costs of raw materials, labour, transport, market conditions, or for any other reason whatsoever.
  3. DELIVERY DATES. are given as estimates only and the Company cannot accept responsibility for any delays however caused.
  4. INCORRECT OR DAMAGED MATERIAL. Any complaint regarding alleged short weight, incorrect or damaged material must be advised to the Company immediately by telephone. Complaints regarding alleged defective material must be made within 3 days after delivery.
  5. QUALITY LIABILITY. The Company accepts no responsibility for contingent or resulting loss, damage or liability caused to the Buyer or anyone else through defective materials.
  6. TERMS OF PAYMENT. Unless otherwise agreed by the Company in writing, payment must be received prior to dispatch of goods.
  7. TITLE TO GOODS. The title to the goods shall remain with the Company until full payment for them has been received from the Buyer. The risk in the goods shall, however, pass to the Buyer at the time of delivery.
  8. The contract shall in all respects be governed solely by English Law.
  9. All orders accepted by the Company subject to the above terms and conditions. No addition or variation can be accepted except by agreement by the Company in writing.
  10. RETENTION OF TITLE. NF Metals shall retain the title to the goods herein until full payment for them at the contract price has been received. In the case of non-payment we shall be entitled to repossess the goods, or the proceeds of sale held by you, or held by any liquidator or receiver.
  11. COMPLAINTS. Any complaint regarding alleged short weight or quality must be advised immediately goods are received and prior to any alteration to the form and original condition of the goods, otherwise no claim can be considered.
